Ross Fired my cousin!

So basically she got a letter today that she was fired and that she was employed for a week even though she never really went to work because the manager told her she needed to show a visa and wouldn't accept the EAD card as proof to legally work. Is there anything she can do? After the manager told her she needed a visa she got a bad vibe and simply decided not to work there which is why she didn't go back and complain. Will the firing stay in her record? They even sent her a check with $0 and the dates of employment.

There's no such thing as some sort of permanent employment record - you just voluntarily divulge employment whenever you want. For a period of 1 week you might as well not mention it.

NO NO NO This is HIGHLY illegal on the part of Ross! If she actually worked there, she is 100% entitled to her pay! She needs to complain to the manager's boss, Ross upper management, or the labor board of her state. They absolutely CANNOT pay her nothing! Even IF she was illegal with no EAD, she cannot be denied her pay.

Take that shit to the news they will GLADLY report on it and make the company look like shit believe me the company will be begging to pay at the end of the day.. Don't let those cock suckers slide.. Take it to the news and take it to court

It shows $0 because she never worked an hour during the week that she was supposedly employed. But she didn't work because they told her she needed to show a visa. Were gonna try to go to the store tomorrow to complain to the manager.

I agree they were wrong to ask for a visa to work, but if she didn't work that week, Ross wouldn't be required to pay her. And what was reason for termination? Because lack of employment documents or because she didn't go to work?

Oh so she didn't work? That's fine then.

Anyway, it's perfectly legal for them to fire/refuse to hire her based on her immigration status as our particular status isn't protected against that (iirc).

Get in touch with someone higher than the manager and complain to them that the manager denied your cousin employment because of his EAD.

I got a job at ross and I showed them my EAD, SSN, and ID and I had no problems with either the background check or e-verify. At no point did they ever asked me to show them a visa.
