chopstix, this is how it works. You are brought here legally to the US when you were a kid. So you are on some visa that is dependent on your parents at the time of your arrival. Your parents then apply for permanent residency but this process takes about 8 yrs or longer. You attend school, college here and then while you are waiting for your permanent residency something happens to your parents or your parents permanent residency application gets denies or you turn age 21. In all the cases you will need to get on some temporary visa like student visa or else they send you back home where you don't belong.

Thus, you are documented and you are legally on a visa like Student Visa because you had no choice to get it in order to stay here. However, you can't work and you have to pay hefty international fees and after your education you pack your bags and you will be forced to leave. This is a very common case not a rare case. Hope this clears up what we were talking about.

thats the case for me. My parents applied for permanent residency but got scammed by some shady guy. They still kept their E-2 visa but I couldnt because i turned 21 already. Im on F-1 visa right now, paying out-of-state tuition, cannot work legally, and etc. I still consider myself lucky because I can get driver's license. Many students are facing similar cases like mine. After we graduate with bachelor's degree, we gotta apply H-1b visa and work 5,6 years under same company/person who sponsor us. However, if something goes wrong in those 5,6 years, we are forced to leave. So I hope this dream act can help us also.

Right on ! Couldn't have said it any better ! Moreover, I'm lucky to be an engineering major where H1Bs are available. What if you were an arts, social science/law, marine biologist, etc etc There are barely any companies that will sponsor you an H1B. Remember, the government jobs require you to be either a citizen or permanent resident so that option is out for you most as well ! Hopefully Dream Act will also apply for us !

thats good. Im a business major and it seems like there are less jobs available right now for business majors.
From what i've seen, nursing students get so much benefit from H1B visas. I have a friend who just finished her nursing program and got a job immediately. She got sponsored from her work and now waiting for her H1B visa. I should've went nursing school

It's ok don't stress...we really can't base our academic and career goals based on some visa or immigration matter...If you have a tough time getting H1B sponsorship, then find an inexpensive state school where you can continue on F1 doing graduate studies. Hope for the Dream Act to pass by that time...If not then I really don't know what we can do...

I'm fighting for the estimated 100,000+ E2 kids that currently lose their right to remain in the Country upon reaching 21.The fact that these kids are not mentioned in the bill concerns me greatly not least because my Son ,now nearly 19 and with 17 of those years in the U.S. needs to also benefit from the bill should it become law.
That several responses on this site claim "their" attorneys believe it would also apply to "legal" visa kids does not really quell my concerns.I have specifically posed this question with both a Senator & Congressman's office here in New Mexico,I will post their definitive responses here in due course.

I would actually support amending the Dream act to include long term legal visa holder whom arrived before the age of 16 & were here for at least 5 years by the time the bill is signed, but I also have a concern that the bill would be amended to benefit only legal visa holders should it come as a stand alone to the Senate floor.

It is also best to speak with either Durbin or Berman's staff who deal mainly with the Dream act & so far the answers I have been given is that is for the undocumented only.

I really doubt that is going to happen. Amending it to benefit ONLY legal visa holders will totally change the main purpose of the bill. I doubt they will get enough votes to do that.

If that is the case then a lot of illegal immigrant students who come here on 'Laser' or other visitor visas and overstay, don't qualify because they are documented ? I have a feeling that they wont exclude them as that will probably consist a large portion of dream act supporters. That is why I believe they did not use the word 'Undocumented' in the bill qualification text.
