I think that the DA is going to pass this time around. Border Security, more ICE agents and more technology is going to be part of the CIR (Comprehensive Immigration Reform). As it stands right now, the DA already has enough strings and hoops. I sent an email to Mr. Lemieux before the Defense Authorization Bill went up for a vote. He replied saying that he wouldn't support the bill because the ammendments that were in the bill. But he would support as a stand alone, I still have his email.

This is not true. 35 is the cutoff age regardless of how many years you attended college. You could have a PHd and it wouldn't matter. Besides, don't think that because someone already has a 4 yr degree they can bypass the waiting period. THEY STILL HAVE TO WAIT the 6 yrs before they can apply for permanent residence. Read the bill.

I agree with DA user, just pass the damn border security and they will hopefully shut up. Seriously, people are acting like there is an alternative. Beggers can't be choosers.
And if they want to take the 35 year old part out, I can't blame them. Might as well make it 55 while we are at it. I have been watching FOX, when they attack the bill, they always bring up the "poor 35 year old child" thing.

And one more thing....based on this video, I would put Lemiux as "on the fence" and not as a Yea. I would edit the senate count, but the nazi who deletes posts that aren't sufficiently optimistic will surely delete my account if I did that.

Hey FloridaRod, DA User is right. If you already have a 2 year degree, you would qualify immediately even if you're 40

This is called the retroactive provision written in the Dream Act.

If you have a 2 year degree, you'll qualify for conditional permanent resident immediately even if you're 40.

maybe I am a bit tired because I have not sleep well lately.... but .... subparagraph F is the one that has the age cap.... its not quoted above, could it be possible...

if that is right.... then according to 5(d)(1)(D), I am covered under the retroactive regardless of the lowering of the age cap... and technically if people have been here and gone through school on schedule, it could be lowered as much as 25 and without screwing up the chances for the people that would complete the college requirement ideally by around age 21 (18-19 graduate from high school 21 should complete at least 2 years of college). But here is the thing, our situation is such that there would be a lot of potential beneficiaries lost through no fault of their own because they have to take a limited number of credit hours to make their education affordable or postpone the education to make the money, or just avoid the education and start working to provide for their families.

I am still against lowering the age cap for those reasons, it would fault a lot of people for what I think its unreasonable.

I just can't believe I never noticed that the retroactive benefits exclude the age cap...

Yup, finally someone got it right !!! The retroactive benefit is kinda under the radar, and not a lot of people has noticed it.
