A work permit is a proof of legal presence (it is listed as a valid immigration document on SSA's site as well). You do not hold legal status but you're nonetheless legally present in US. In addition being granted deferred action also makes you legally present in the country, even if you do not have a work permit, as do a bunch of other things (ex. being brought in for trial from abroad) without giving you legal status.
