From @thetoddschulte (President FWD.us) on Twitter:

Below is our predicted timeline for how DACA will likely continue through the courts:

1. June 1, 2023. Judge Hanen hears oral arguments on Texas vs the United States on DACA.

2. Assuming a negative ruling, this case will return to the Fifth Circuit Court of Appeals and they will likely hear the case sometime between the early spring to fall of 2024. The Fifth Circuit would then issue a decision; a negative decision could include removing the current stay on renewals, meaning DACA renewals would be halted. The Fifth Circuit ruling regardless of the decision, will likely be appealed to the Supreme Court.

3. It is possible that the Supreme Court takes this case for the 2023-2024 session, but due to the estimated timeline, the Supreme Court will likely not have the option to take the case in time for the Spring 2024 session, meaning the earliest the Supreme Court court rule on this case would be in the Spring of 2025

I would say to anyone interested in staying in America for the rest of their lives, figure out a way to get AOS now, you have about two years to work it out!

I hate to be a Bingo here but after the Roe v. Wade overturned ruling, I don’t see this Supreme Court ruling in favor of daca

2025 isn’t too far away either. But also at this point; daca has been alive 11 years, we really should have AOS via marriage by now

I can see Hanen leaving DACA renewals for now until the SC makes a final ruling.

yeah 2 years left if the democrats win 24. this could be our last renewal.

but chances are that Trump will come back and fix everything and we get legalized thanks to him pressuring congress. then all the media will seethe and cope to infinity.

According to Todd, Hanen doesn’t have the ability to overturn the stay on renewals. The 5th circuit does & they technically could do it when they hear the case but we’ll see.

So what the heck happened at the hearing?

There's almost no news or reports at all

After hearing on motions in #DACA case today, Judge Hanen says will rule "in due course." TBD how long that means

What happens now?

Although immigration lawyers say Hanen could rule immediately, they say a decision will likely take a few months.

Because of a federal appeals court order, Hanen cannot prevent existing DACA recipients from renewing their status. DACA recipients must renew their status in the program every two years.

“Therefore, renewals are expected to remain in place until and if a higher court ends them,” Todd Schulte, president of FWD.us, an immigration and criminal justice organization, wrote in an email to the media.
