Undocumented students residing in New York can pay in-state tuition at New York universities and colleges because of a law passed by the New York Legislature as set forth in S. 7784/Bill No.

In-state Tuition in the State of New Mexico

Students residing in New Mexico, who meet the following requirements are eligible to pay in-state tuition at New Mexico colleges and universities.

Effective as of March 15, 2005.

Requirements

  • Attended a New Mexico high school for at least a year and
  • Graduated from a New Mexico high school or obtained a GED in New Mexico

In-state Tuition in the State of Nebraska

Students residing in Nebraska and fulfilling the requirements stated below are allowed to pay in-state tuition at public colleges and universities of Nebraska set forth by Legislative Bill 239 of the 99th Nebraskan Legislature.

Effective as of July 13, 2006.

In-state Tuition in the State of Kansas

Undocumented students residing in Kansas and who meet the following requirements are eligible to pay in-state tuition at Kansas universities and colleges as set forth by HB 2145.

In-state Tuition in the State of California

Students residing in California and meet the following requirements are eligible to pay in-state tuition at California colleges and universities.

Effective as of October 12, 2001.

Requirements

  • Attend a California high school for three or more years
  • Graduate from a California high school or receive a GED from California
  • Provide an affidavit stating the student will apply for legalization once he/she is eligible to do so

In-state Tuition in the State of Illinois

Undocumented students residing in Illinois and meeting all of the following requirements are able to pay in-state tuition at public colleges and universities of Illinois set forth by House Bill 60 of the 93rd Illinois General Assembly.

What do you mean by in-state tuition?

In response to the lack of federal legislation that addresses the needs of undocumented students some states have taken the initiative to provide in-state tuition to undocumented students who are residents of the state and have graduated from a High School within that state. There are currently nine states that have passed legislation to provide in-state tuition to undocumented students.

Basic Information about the DREAM Act Legislation

This information is based on the current legislation introduced on March 26, 2009 by Senator Richard Durbin and Representative Howard Berman.

Purpose

The purpose of the Development, Relief and Education of Alien Minors Act, also called the DREAM Act, is to help those individuals who meet certain requirements, have an opportunity to enlist in the military or go to college and have a path to citizenship which they otherwise would not have without this legislation.
